The petitioner seeks bail in a case registered under Sections 396, 397 of the Indian Penal Code.

The prosecution case in brief is that in the night of 23-052015, 10-15 dacoits entered into house of the informant and assaulted his mother by rod and thereafter, the accused persons killed his father stabbing several knife several times. It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 22-02-2018. Charge sheet has already been submitted. The petitioner has remained in custody for more than one and a half year. The petitioner is not named in the FIR. He has not been put on test

Patna High Court CR. MISC. No.17172 of 2019(5) dt.08-08-2019 2/2 identification parade. There is no recovery of any incriminating article from possession of the petitioner.

On behalf of the State, it is submitted that the petitioner is not named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, the petitioner named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Madhubani in connection with Andhrathadhi Town P.S. Case No. 57 of 2015. (Sudhir Singh, J) A.K.V.//- U T
