JUSTICE SATYAVRAT VERMA ORAL ORDER 08-04-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Sections 30(a), 30(g), 38(i), 41(i) and 41(ii) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 23.12.2021, charge-sheet has been submitted in the case and has antecedent of one case. Allegation is of recovery of 2330 litres of liquor from cartons kept in a truck.

Learned counsel for the petitioner submits that the petitioner was not arrested from the spot and his name was disclosed by the local chowkidar with whom he is on an inimical term.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case and was not arrested from the spot, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Runnisaidpur P.S. Case No. 450 of 2019.
