2. The petitioner apprehends his arrest in connection with Azamnagar P.S. Case No. 225 of 2013 registered for the offence punishable under Sections 341, 384, 386, 506/34 of the IPC.

3. Allegedly, an agreement was entered into between the informant Md. Sahajaan and the petitioner for sale and purchase of the land and for that purpose, the informant gave him Rs. One lakh to the petitioner. On 02.10.2023, while the informant reached at Chachal to get the land registered, the petitioner refused to do so.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.15819 of 2025(2) dt.02-04-2025 2/2 that the petitioner is innocent and he has falsely been implicated in this case. There is no piece of evidence showing that the petitioner has received Rs. One lakh as earnest money for purchasing the land of the informant. The petitioner is a resident of West Bengal and there is no reason for him to receive Rs. One lakh in Katihar district.

5. Learned counsel appearing for the State has opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, let the petitioner named above, in the event of arrest/surrender within four weeks before the court below be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of leanred ACJM, Katihar subject to the conditions as laid down u/S 438(2) of the Cr.P.C.
