2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 124(A) of the Indian Penal Code and Sections 16(i)(b)/18/20 of the U.A.P. Act.
3. As per allegation in the FIR, two accused persons, namely Surajmal Yadav and Kishori Yadav were apprehended by the police, and posters related to Naxal Party were recovered from their possession.
4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Petitioner has no concern with the apprehended accused persons. He is not named in the FIR. It is further submitted that similarly accused
Patna High Court CR. MISC. No.21712 of 2023(3) dt.28-08-2023 2/2 persons has already been enlarged on bail vide order dated 29.02.2020 passed in Cr. Misc. No. 4454 of 2020. Petitioner is languishing in judicial custody since 16.10.2020.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Subdivisional Judicial Magistrate (Sherghati), Gaya in connection with Chakkarbandha P.S. Case No. 03 of 2019.
