JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-06-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 376/511, 307, 506 and 504/34 of the Indian Penal Code.

It is alleged that the petitioner came to the room of the informant in the night, tried to strip her and attempted to establish forceful physical relationship and when she made protest, the injury with knife was inflicted.

It is submitted by learned counsel for the petitioner that there is counter version of the occurrence also and in the background of land dispute, the accusation has been levelled and even assuming the accusation, no offence under Sections 376/511 and 307 of the IPC are made as doctor has found one cut injury of marginal size.

Patna High Court Cr.Misc. No.24411 of 2015 (2) dt.29-06-2015 2/2 Considering the nature of accusation, this Court is not inclined to grant anticipatory bail to the petitioner. Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Uchakagaon P.S. Case No. 221 of 2014 pending in the court of learned JM, 1st Class, Gopalganj. Accordingly, the application is disposed of.
