Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Majhaulia P.S. Case No. 921 of 2022 dated 24.11.2022 lodged under Section 302/34 of the I.P.C.

As per prosecution case, this case of murder of the deceased has been lodged against eight named accused persons including the present petitioner.

Learned counsel for the petitioner submits that from the content of the F.I.R., it transpires that the allegation made in such a way that eight persons have surrounded the victim, on the order given by the Deo Kumar Sharma, Awadhesh Sharma caught and Shatrughan Sharma has attacked by iron rod which subsequently resulted into death of the victim. Patna High Court CR. MISC. No.16556 of 2023(2) dt.10-05-2023 2/2 for the petitioner submits that there is no specific allegation against the present petitioner, save and except that general and omnibus allegation is that he is a member of mob. Learned counsel for the petitioner further submits that petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 08.12.2022 having clean antecedent and charge sheet has already been filed in this case. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran, Bettiah in connection with Majhaulia P.S. Case No. 921 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C..

With this observation, the bail application stands allowed.
