This application is for grant of anticipatory bail in connection with Case No.C2-30/17 for the offences under Sections 30(A)(D)2 of Bihar Prohibition and Excise Act, 2016. Allegation against the petitioner is about recovery of 125 ltrs. of liquor from the hut of the petitioner and further appears that the villagers have disclosed the name of the petitioner.

Submission of the learned counsel for the petitioner is that the hut does not belong to the petitioner and further he has no criminal antecedent.

Heard learned A.P.P., who has opposed the prayer for bail on the ground that there is prima facie allegation against

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner surrender before the learned court below and make prayer for regular bail, which will be considered on its own merit and if possible to be disposed of on the same day.
