The petitioner seeks bail in connection with Bettiah Town P.S. Case No. 337 of 2017 dated 11.05.2017 instituted for the offences under Sections 302, 120(B) and 34 of the Indian Penal Code and Section 27 of the Arms Act.
It has been submitted on behalf of the petitioner that he has been made accused in this case on the confession of one Suraj Mahto and later, after his arrest, on his own confession. One accused Bablu Dubey who was being produced in the court was shot at from the crowd leading to his death. Suraj Mahto, the accused who was arrested during the investigation of the case has disclosed that he had stayed, a day prior to the occurrence, at the house of the petitioner, where a conspiracy was hatched for killing
Patna High Court Cr.Misc. No.48022 of 2017 (3) dt.05-12-2017 the deceased, Bablu Dubey.
Learned counsel for the petitioner has submitted that there is no other material except what has been stated above. He is in custody since 16.05.2017. The petitioner, apart from the present case has been made accused in about seven cases, reference of which has been given in para-3 of the petition. Dr. Amrendra Kumar, learned counsel for the petitioner submits that in all such cases, the petitioner is on bail.
Regard being had to the aforesaid facts, the petitioner above named is directed to be released on bail on his furnishing bail bond in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah in connection with Bettiah Town P.S. Case No. 337 of 2017.
