1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Taraiya P.S. Case no.133 of 2023 registered under sections 307, 323, 324, 341, 504 and 34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner and two others are said to have come variously armed, to have abused the informant and others and thereafter it is stated that the petitioner who was armed with a katta assaulted with the butt of the pistol on the nose of informant causing grievous injury. It is further stated that Dinesh Rai has also assaulted the informant with a rod while Annu Rai assaulted the informant's father which also caused grievous injury.

4. It is submitted by learned counsel for the

Patna High Court CR. MISC. No.20312 of 2024(3) dt.04-04-2024 2/2 petitioner that the petitioner has been falsely implicated in the case for oblique reasons. The manner of occurrence is other than what has been narrated in the FIR. Co-accused Annu Rai has been enlarged on bail by the learned Court below itself. The petitioner is in custody since 17.1.2024 and has no criminal antecedent.

5. The application for bail is opposed by learned A.P.P. for the State and learned counsel for the informant.

Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R., grant of bail to the coaccused Annu Rai, the petitioner having remained in custody since 17.1.2024 and not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Taraiya P.S. Case no. 133 of 2023 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Saran at Chapra.
