The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504 and 506/34 of the Indian Penal Code. The FIR would reveal that allegation of commission of assault causing injury at the head of the brother of the informant as well as of the informant by four named persons including the petitioner. However, the doctor has found single head injury, simple in nature, caused by hard and blunt substance on the head of Bipin Yadav.
Since, it is difficult to attribute as to who of the four had caused single head injury, let the petitioner, above named, in the event of his arrest or surrender before the Court below
Patna High Court CR. MISC. No.15239 of 2019(2) dt.12-03-2019 2/2 within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court-below where the case is pending in connection with Amarpur (Fullidumar) Police Station Case No. 473 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
