This is a petition for anticipatory bail for the offences under Sections 147, 148, 149, 323, 324, 307, 427, 379 and 504 of the I.P.C.
There is case and counter case.
Learned counsel for the petitioner submits that the present F.I.R. has been lodged against the petitioner in retaliation of a case bearing Hilsa P.S. Case No.81/16 registered under Sections 307, 302/34 and other minor sections of I.P.C. against the informant, Anuj Kumar of Hilsa P.S. Case No.82/16 and his family members for murder of the brother of the petitioner, Ajit Kumar by Anuj Kumar in which co-accused of the present case also sustained injuries.

No.19535 of 2016 (2) dt.14-06-2016 2/2 There is allegation against the petitioner that while the informant was giving fodder in the tub of cattle the petitioner along with other co-accused gave lathi blow on the informant by which the informant, Anuj Kumar received injury. Learned counsel for the petitioner submits that the injury on the person of the informant Anuj Kumar is simple in nature.
However, it is submitted that though supplementary affidavit along with injury report contained in Annexure-2, has been filed which shows that the injuries of Ajay Kumar son of Sunil Kumar is simple in nature. But it is asserted that the name has been wrongly mentioned.
Hence, having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of A.C.J.M., Hilsa, in Hilsa P.S. Case No.82/16 subject to the conditions as laid down under Section 438(2) of Cr.P.C. (Gopal Prasad, J) AnilKrSinha/- U T
