JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-06-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 25.4.2017 passed in Cr.Misc.No.15276 of 2017 with an observation to conclude the trial within a period of nine months.
Submission of learned counsel for the petitioner is that till date only one witness has been examined and there is no eyewitness to the occurrence and there is allegation of throwing dead body and co-accused has been granted bail by this Court vide order dated 2.5.2018 passed in Cr.Misc.No. 19713 of 2018 and petitioner is in custody since 21.12.2016.

Having heard both sides and in the facts and circumstances and considering the period of custody, let the
Patna High Court Cr.Misc. No.36197 of 2018 (2) dt.27-06-2018 2/2 petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of 1st Additional District and Sessions Judge, Katihar, in connection with Sessions Trial No. 292/295 of 2017, arising out of Amdabad P.S.Case No. 120 of 2016, subject to the conditions that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and petitioner has to co-operate in disposal of trial and appear before the trial court as and when required, otherwise his bail bond shall be cancelled.
