JUSTICE BIRENDRA KUMAR ORAL ORDER 29-06-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code.

According to FIR, the son of the informant was in love with the daughter of FIR named co-accused-Om Prakash Yadav, which was not liked by Om Prakash Yadav and for that reason, Om Prakash Yadav and others allegedly committed murder of the son of the informant. Allegation against the petitioner is that he alongwith co-accused Sunil Yadav had taken the deceased from his house.

Submission is that Om Prakash Yadav has already been allowed bail vide Annexure-2 and Sunil Yadav

Patna High Court Cr.Misc. No.36185 of 2018 (2) dt.29-06-2018 2/2 has also been allowed bail by a Coordinate Bench of this Court.

Considering the aforesaid submission, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Kusheshwar Asthan Police Station Case No.231 of 2017, corresponding to G.R.No.911 of 2017, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
