JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections, 272, 273, 307 of the Indian Penal Code and under Section 47(a) of the Excise Act. On information that Mahua liquor was being transported, an auto rickshaw was intercepted. One accused person from the auto rickshaw escaped from the scene but the driver of auto rickshaw, Shyamji Paswan, was apprehended who disclosed the name of the petitioner, as the person who escaped from the scene. From the auto rickshaw 200 liters of country made Mahua liquor were seized.
It is submitted by the learned counsel for the petitioner that petitioner is in no way connected with alleged Mahua liquor.
Patna High Court Cr.Misc. No.19791 of 2016 (2) dt.04-05-2016 2/2 The auto rickshaw is registered in the name of father of the petitioner. Statement has been in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Aurangabad in connection with Barun P.S. Case No. 33 of 2016 subject to the conditions as laid down under Section 438(2) Cr.P.C.
