Petitioner, already in custody, seeks bail in connection with Antichak P.S. Case No.51 of 2017 registered under Sections 342, 323, 376, 313 and 506 of the Indian Penal Code as well as under Section 4 of the POCSO Act.

Allegation in brief is that the prosecutrix came in contact with the petitioner on mobile and thereafter the petitioner established physical relationship and exploited her sexually for last one year, when she became pregnant, the petitioner got her pregnancy terminated and later on sent her back to home and refused to marry.

Learned counsel for the petitioner submits that the girl

Patna High Court Cr.Misc. No.36295 of 2018(2) dt.28-06-2018 2/2 is major and there is no medical evidence on record that she was raped or pregnancy was terminated.

Having considered the aforesaid facts and circumstances, petitioner Vineet Kumar @ Binit Kumar @ Binit is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional District & Sessions Judge, Bhagalpur, District Bhagalpur in connection with Antichak P.S.
