The petitioners, three in number, apprehend their arrest in a case under Section 385 and other sections of the Indian Penal Code and Section 3(i)(x) of the SC/ST Act. The informant made allegation that the petitioners demanded extortion and are bent upon to dispossess him from the land purchased by him from the uncle of the petitioners. It is submitted that for settling the land dispute between the parties, Title Suit No. 280/2014 is pending in the court of the Sub Judge I, Muzaffapur. Prior to lodging of this case, the petitioners lodged Sadar P.S. Case No. 437/2013. No offence under Section 3(i)(x) of SC/ST Act is made out and the same is resorted to make the case graver to put pressure for settling the land dispute.

No.24087 of 2015 (2) dt.09-07-2015 2/2 Considering the facts aforesaid, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffapur in Sadar P.S. Case No. 87/2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Dilip/- U T
