JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-05-2019 This is an application for grant of anticipatory bail in connection with Samastipur (M) P.S. Case No. 455 of 2018, disclosing offences under Sections 147, 148, 149, 307, 323, 325, 354(B) and 452 of the Indian Penal code.

Allegation against the petitioners is that on the order of petitioner no.1, petitioner no.2 and petitioner no.3 has dragged the informant on the ground and petitioner no.4 and 5 try to misbehave with the daughter of the informant and further allegation against petitioner no.1 is that he assaulted by danda on the head of the informant, but that hit on the hand causing

Submission of learned counsel for the petitioners is that all the petitioners are Gotiya of the informant and injuries attributed by these petitioners are not on the vital part of the body and other allegation appears to be ornamental in nature. Heard A.P.P. as well as learned counsel for the informant, who opposed the prayer for anticipatory bail to the petitioners.

Having heard both sides, in view of the facts and circumstances as stated above, let petitioners, above named, be surrender within a period of four weeks from the receipt of this order and on verification of criminal antecedents of the petitioners, if they are not found in any other case, the petitioners shall be released on bail on furnishing bail bond of Rs. 25,000/-( Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-5, Samastipur in connection with Samastipur (M) P.S. Case No. 455 of 2018, subject to that condition that laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) Amjad/SKSuman.
