The petitioner, in the present case, is seeking regular bail in connection with Ashok Paper Mill P.S. Case No.18/2018, registered for offences alleged under Sections 147, 148, 149, 447, 448, 341, 342, 323, 307, 302, 354 and 379 of the Indian Penal Code.
Learned counsel for the petitioner submits that from the First Information Report it would appear that there are altogether 7 accused persons against whom the allegation is that they entered in the house of the deceased Mithilesh in drunken condition. Learned counsel submits that so far as the allegation of assault is concerned, it is specifically made against the co-accused
Patna High Court Cr.Misc. No.37382 of 2018 (2) dt.29-06-2018 Biru and Rajeev who are said to have assaulted the deceased on his head because of which he fell down and ultimately died. Learned counsel submits that so far as the present petitioner is concerned, there is no specific allegation of committing any over act against him.
Learned APP for the State is present.
Considering the facts and circumstances of the case whereunder it appears that specific allegation of assault is against co-accused Biru and Rajeev and that the petitioner has no criminal antecedent, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in connection with Ashok Paper Mill P.S. Case No. 18 of 2018, subject to the conditions U/S 437(3) Cr.P.C.
