JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 04-10-2021 Learned counsel for the petitioner undertakes to remove all the defects as pointed out by office within four weeks after start of normal functioning of the Court. Heard learned counsel for the petitioner and Ms. Anita Kumari Singh, learned A.P.P. for the State.

Petitioner in the present case is seeking regular bail in connection with Baruraj P.S. Case No. 108 of 2020 registered for the offence punishable under Section 272, 273, 34 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act. The petitioner is in custody since 09.01.2021. The petitioner is an accused in six cases as stated in paragraph '3' of the application.

As per the prosecution story, while the informant was on patrolling duty and checking the vehicle alongwith police

No.26943 of 2021(2) dt.04-10-2021 2/3 personnel, in the meantime, he got secret information that businessman of illicit liquor namely Mintu Singh (the petitioner) assaulted Shamsad, thereafter he reached there and saw one person lying in the injured condition, the injured person disclosed his name as Shamsad and said that Mintu Singh has concealed illicit liquor in the garden. The informant went there and recovered total 152.280 liters of illicit liquor. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Learned counsel submits that the petitioner has got one criminal antecedent in which he is on bail. The petitioner is in custody in connection with this case since 09.01.2021. Ms. Anita Kumari Singh, learned A.P.P.

for the State has opposed the prayer for regular bail of the petitioner.

Patna High Court CR. MISC. No.26943 of 2021(2) dt.04-10-2021 3/3 Court is not inclined to release the petitioner on bail at this stage. The prayer for bail of the petitioner is, thus, refused. Let the trial be expedited.

The court below is expected to conclude the trial as early as possible and all endeavours be made to conclude the trial within a period of nine months from the date of communication of this order. If the trial still remains unconcluded for no reason attributable to the petitioner, he may renew his prayer for bail.
