JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-05-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 302 and some other ancillary Sections of the Indian Penal Code and under Section 37 (a)(b), 34(a)(b)(i) of the Bihar Prohibition & Excise Act. It is a case of consuming spurious liquor.
Learned counsel appearing for the petitioner submits that petitioner is not named in the FIR. The name of petitioner has come in this case during the course of investigation and only material that has come against this petitioner is that husband of petitioner brought spurious liquor at his house which was being sold by this petitioner. Petitioner claims clean antecedent and is in custody since 28.08.2021 and investigation in this case is complete.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Vaishali at Hajipur in connection with Jurawanpur PS case No.73/2021.
