20-05-2016 Heard Sri Pankaj Kumar Sinha, learned counsel for petitioners and Sri Damodar Prasad Tiwary, learned Addl. Public Prosecutor.

Four petitioners, apprehending their arrest in Kotwali P.S. Case No. 4 of 2016 registered for the offence under Sections 341, 323, 379, 354, 504, 307, 34 of the Indian Penal Code, have prayed for grant of anticipatory bail.

Learned counsel for petitioners submits that there is no specific accusation against any of the petitioners. He further submits that there was case and counter case. Prior to filing of present case, from the petitioners' side, an F.I.R. was lodged, vide Kotwali P.S. Case No. 3 of 2016. On aforesaid ground, a prayer

Patna High Court Cr.Misc. No.19698 of 2016 (2) dt.20-05-2016 2/2 has been made for extending the privilege of anticipatory bail. I have perused the F.I.R. After going through the material on record, I do not find any ground for extending the privilege of anticipatory bail to petitioner no. 1 to 3. So far as petitioner no. 4 is concerned, keeping in view the fact that she is lady, in the event of her arrest or surrender within a period of six weeks from today, let the petitioner no. 4 namely Dulari @ Sabina @ Dulari Sabina be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger in connection with Kotwali P.S. Case No. 4 of 2016 subject to condition as contemplated under Section 438(2) of the Cr.P.C.
