JUSTICE SUDHIR SINGH ORAL ORDER 16-09-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 147, 148, 149, 323, 447 and 302 of the Indian Penal Code.

Allegation against the petitioners is that due to some scuffle took place among the children, they armed with lathi and Danda entered into the house of the daughter of the informant and assaulted her. Later on, daughter of the informant succumbed to her injuries.

It has been submitted on behalf of the petitioner that petitioners have got no criminal antecedent. It is further submitted that there is no specific allegation of assault against the petitioners. There is general and omnibus allegation against the petitioners. It is also submitted that after a period of two days from the date of occurrence, there was bleeding from the nose of the deceased and

Patna High Court Cr.Misc. No.24037 of 2015 (3) dt.16-09-2015 2 / 2 she died because she was a T.B. patient for last 3 to 4 months. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts, let the above named petitioners, in the event of arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda, in connection with Bihar P.S. Case no. 79 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sudhir Singh, J) sudip/- U T
