Petitioner seeks bail in Deep Nagar P.S. Case No.399 of 2018 instituted for the offence under Section(s) 302, 120-B Indian Penal Code and Section 27 of the Arms Act. Counsel for the petitioner submits that in the written report there is no specific overt act alleged against the petitioner. In the written report, it is alleged that younger son of the informant, Rahul Kumar, sustained gun shot injury. He told the informant that Rakesh Kumar has caused firearm injury to him. Son of the informant was taken to PMCH where he died during course of treatment.
In this manner, from the First Information Report, it is apparent that injured has levelled specific allegation against

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Deep Nagar P.S.
