The petitioner seeks bail in anticipation of his arrest in connection with Forbesganj (Simraha) P.S. Case No. 32 of 2017 dated 17.01.2017 instituted for the offences under Sections 341, 342, 324, 379, 504, 506/34 and 307 of the Indian Penal Code.
On the charge of the informant about instigating a tractor driver of the village in not plaughing the field of the brother of the petitioner, an occurrence took place in which the petitioner is alleged to have given a blow on the head of the informant by means of an iron rod. There are other allegations of taking away of personal belongings, but that allegation is attributed to others.
Learned counsel for the petitioner has
Patna High Court Cr.Misc. No.34629 of 2018(4) dt.19-07-2018 2/2 submitted that the injuries suffered by the informant have been opined to be simple in nature. The petitioner is a co-villager of the informant and he has been made accused in this case because of the dispute between the informant and the brother of the petitioner.
The petitioner does not have any criminal antecedent.
For the aforesaid facts, the petitioner abovenamed is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Forbesganj (Simraha) P.S. Case No. 32 of 2017, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
