Petitioner, already in custody, seeks bail in connection with Araria Mahila P.S. Case No.51 of 2017 registered under Sections 376, 313, 340 and 323/34 of the Indian Penal Code. Later on Section 302 of the Indian Penal Code was added. Learned counsel for the petitioner submits that the allegation of commission of rape is against one Md. Sohrab and the petitioner is the Asha Worker and not a nurse. Allegation is that the pregnancy of the daughter of the informant was terminated by the petitioner but there is no other material to show that she terminated the pregnancy and this petitioner has no criminal antecedent.

Having considered the aforesaid facts and

Patna High Court Cr.Misc. No.34572 of 2018(3) dt.29-06-2018 2/2 circumstances, petitioner Bibi Anwari is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Araria in connection with Araria Mahila P.S. Case No.51 of 2017.
