The petitioner seeks bail in a case registered under Sections 398, 307 of the Indian Penal Code and 27 of the Arms Act. The prosecution case in brief is that while the informant along with one another person was going his home, six accused persons boarding on two motorcycles came and, companion of the informant was assaulted with Lathi and thereafter, other accused persons fired upon the informant and in the meanwhile, having seen a Bolero coming towards the place of occurrence, the accused persons fled away.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 09-10-2018. Charge sheet has already been submitted. The FIR is against unknown. During

Patna High Court CR. MISC. No.16411 of 2019(3) dt.24-04-2019 2/2 investigation, one co-accused was apprehended and in his confessional statement, the name of this petitioner transpired. The petitioner was not put on Test Identification Parade. There is no recovery of any looted articles from possession of the petitioner. The other co-accused namely Ashok Yadav with similar allegation has been granted bail by a coordinate bench of this court vide order dated 15-04-2019 passed in Cr. Misc. No. 24084 of 2019. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, the petitioner named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Jamui in connection with Jhajha P.S. Case No. 68 of 2017.
