Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 409, 420, 448, 467, 471, 120B of the Indian Penal Code. On the basis of information given by one Amar Mahto(Ex-Sarpanch) to Deputy Superintendent of Police, Areraj, First Information Report was instituted. The allegation is that the members of the Panchayat Samiti along with and in connivance with officials have allocated Indira Awas to the normal persons which were to be allocated to the handicapped persons.
It is submitted by learned counsel for the petitioner that petitioner was not named in the First Information Report but subsequently his name transpired
Patna High Court Cr.Misc. No.24050 of 2015 (2) dt.10-07-2015 2/2 during investigation. It is further submitted that allotments were made on the recommendation of the gram panchayat and co-accused have been granted anticipatory bail vide Cr. Misc. Nos. 46541 of 2014, 23099 of 2015, 23568 of 2015, 24840 of 2014, 22008 of 2014.
Considering the fact that F.I.R named coaccused with specific accusation have been granted anticipatory bail whereas petitioner's name transpired during investigation, let the petitioner, above named, in the event of her arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari in connection with Paharpur P.S. Case No. 188 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
