JUSTICE ARUN KUMAR ORAL ORDER 28-06-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 3.4.2018, seeks bail in Begusarai Muffasil PS Case No. 129 of 2017 registered under Section 376 of the IPC.

The allegation in brief is that the petitioner knocked the door of the informant, entered inside and committed rape, in the meanwhile her husband turned up and apprehended him. Learned Counsel for the petitioner submits that the petitioner is co-villager and has falsely been implicated in this case, it is alleged that the petitioner was apprehended by her husband on the spot but the case was lodged after four days, the prosecutrix is a married lady and the medical evidence does not suggest that rape was committed on her.

Having considered the said facts and circumstances, the petitioner, namely, Chandan anti @ Chandan Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Begusarai in connection with Begusarai Muffasil PS Case No. 129 of 2017.
