The petitioner apprehends his arrest in Muffasil P.S. Case No. 10 of 2020, registered for the offences punishable under Section 302 and other allied sections of the Indian Penal Code.

As per the FIR, allegation against this petitioner is that he along with co-accused persons killed the brother of informant and threw the dead body.

It is submitted that specific accusation of assault is against co-accused Ajay Manjhi and Chintu Paswan. So far as this petitioner is concerned, there is no specific overt act against him. Moreover, FIR has been lodged after delay of two days of

Coaccused Ajay Manjhi has been granted bail by a coordinate Bench of this court vide order dated 24.07.2021 passed in Cr. Misc. No. 31111 of 2020. Petitioner claims clean antecedent. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Muffasil P.S. Case No. 10 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
