The petitioner apprehends his arrest in connection with Kuchaikot P.S. Case No. 242 of 2017 registered under Sections 272/273, 420 of the Indian Penal Code and Section 30(a)(b)(c) of the Bihar Prohibition and Excise Act. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further he submits that from perusal of Seizure List, it is apparent that the alleged recovery has been made from the Truck. The petitioner is neither the owner of the said truck nor the seized foreign liquor belongs to the petitioner. Petitioner has no criminal antecedent.

Case No. 242 of 2017, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
