By the impugned order, the Court below considering the decision of Patna High Court as well as Supreme Court has rejected the amendment application filed by the petitioner in the written statement on the ground that evidence of the plaintiff have already been closed and if this amendment sought for allowed, it will prejudice the plaintiff.

Since the order passed by the Court below based on the decision of this Court as well as Supreme Court mentioned in the order of the trial Court, I do not find any reason to interfere with the order passed by the Court below.

Thus, this writ application is dismissed.
