JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-05-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 447,341,323,384 and 504/34 of the Indian Penal Code. The prosecution case is that a road was being constructed under Mukhyamantri Gram Sampark Yojna. As soon as the informant started work, accused persons came variously armed and on the order of co accused Manoj Sah, the informant was being assaulted by the accused persons and they took away rupees thirty eight thousand from the pocket of the informant his

Patna High Court Cr.Misc. No.19795 of 2016 (2) dt.04-05-2016 2/2 wrist watch. It is further alleged that the accused persons demanded extortion amount of rupees one lac for allowing the construction work to proceed.

It is submitted by the learned counsel for the petitioners that there is counter version of the occurrence and the petitioner no. 2 filed Complaint Case no. 3333 of 2015 against the informant. It is further submitted that the accusation is not specific against the petitioners. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Araria in connection with Narpatganj P.S. Case No.452 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
