This application, for grant of anticipatory bail, arises out of Kinjar Police Station Case No. 54 of 2018, disclosing offences under Sections 147, 149, 341, 323, 332, 337, 338, 353, 504, 506 of the Indian Penal Code.
The allegation against the accused persons is to the effect that they were raising slogans against the administration and were demanding compensation against the death of a person. They are said to have obstructed free flow of traffic and caused obstruction in due discharge of official duties by the police party.
Learned Counsel appearing on behalf of the petitioner
Patna High Court CR. MISC. No.15917 of 2019(2) dt.14-03-2019 2/2 has submitted that there is no specific allegation of any overt act against the petitioner, who has no criminal antecedent. Considering the general nature of accusation made in the First Information Report, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Arwal, in connection with Kinjar Police Station Case No. 54 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
