JUSTICE SANJAY KUMAR ORAL ORDER 20-09-2017 Heard learned counsel for the petitioner and learned A.P.P. appearing on behalf of the State.

The petitioner seeks regular bail in connection with Belaganj P.S. Case No. 124 of 2017 registered for the offences punishable under Sections 395 and 397 of the Indian Penal Code.

It has been submitted that the petitioner is neither named in the F.I.R. nor there is any specific allegation against him. The petitioner's name appeared in re-statement of the informant. The petitioner was apprehended by police on 25.04.2017 and there is no criminal antecedent against the petitioner. The allegation of intercepting the informant, snatching cash amount and other articles is not specific against the

It has been further submitted that one of the F.I.R. named accused person namely, Fulan Yadav has been allowed bail vide order dated 20.09.2017 passed by another co-ordinate Bench of this Court in Criminal Miscellaneous No. 42593 of 2017 with certain conditions and so, this petitioner also deserves to be enlarged on bail.

The learned APP for the State opposed the submission.

Considering the nature of allegation, facts and circumstances of the case, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of the learned A.C.J.M.-XI, Gaya in connection with Belaganj. P.S. Case No. 124 of 2017.
