Petitioner apprehends arrest in connection with Barun P.S. Case No. 85 of 2018 registered for the offence punishable under Sections 379, 411, 420/34 of the Indian Penal Code and Sections 4, 40 of Bihar Minor Mineral Concession Rule and Section 15 of Environment Protection Act.
Learned counsel appearing for the petitioner submits that the alleged seized Sonalika Tractor listed at sl. no.9 of seizure list was loaded with sand purchased from Aditya Multicom Pvt. Ltd. after having a genuine challan on 23.04.2018 i.e. date of occurrence, but inspite of showing valid challan the vehicle was seized. It is further submitted that the petitioner is not the owner of

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Aurangabad in connection with Barun P.S. Case No. 85 of 2018 subject to the conditions laid down under Section 438(2) Cr.P.C. (Arvind Srivastava, J) N.H./- U T
