JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-09-2017 Heard the parties. The petitioner seeks regular bail in Hilsa P.S. Case No.451 of 2017 registered for the offence under Section 370/34 of the I.P.C.

Allegation against the petitioner is that the eight months earlier he along with another co-accused had taken the husband of the informant to Haryana for working at brick kiln and since then the husband of the informant is traceless. Submission of the learned counsel for the petitioner is that earlier to this case a Complaint Case No.305C/2016 had been filed by the informant wherein she has stated that her husband was

No.41523 of 2017 (2) dt.07-09-2017 2/3 working as Munsi of the said brick kiln due to which he had given Rs.40,000/- to the petitioner and co- accused Sanjay and thereafter they did not return there and since then her husband is traceless. It has also been submitted that Haryana police had also gone to the petitioner searching him .This petitioner has been in custody since 21.07.2017.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of A.C.J.M. -1st, Hilsa, Nalanda, in Hilsa P. S. Case No. 451 of 2017 subject to the conditions that (1) one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court. (2) The petitioner will not induce any witness or tamper with the evidence. (3) The petitioner shall co-operate in disposal of trial and make himself available as and when required by the court. In the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reason, his bail bond shall be cancelled. He shall also cooperate the informant
