The petitioner seeks bail in a case registered under Section 366(A)/34, 504 of the Indian Penal Code.

The earlier bail application of the petitioner was rejected vide Annexure 1 to the present application with an observation 'at this stage'.

A report was called for from the court below regarding the stage of trial. It has been reported that after examination of two prosecution witnesses, no witness is being produced on behalf of the prosecution. There is no likelihood of trial being concluded in near future.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 16.04.2018 and has got no criminal

Patna High Court CR. MISC. No.24150 of 2019(3) dt.03-07-2019 2/2 antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the complaint case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 1st, Munger in connection with S.T. No.189 of 2018 arising out of Dharhara (Hemjapur) P.S. case No.75 of 2018.
