JUSTICE PARTHA SARTHY ORAL ORDER 03-06-2020 Heard learned counsel for the petitioner and learned APP for the State, through video confrencing. The petitioner has filed the instant application for grant of regular bail in connection with Bettiah Town P.S. Case No. 589 of 2019 registered for the offence under sections 420, 406, 379, 504, 506 and 34 of the Indian Penal Code and section 138 of the N.I. Act.
As per allegation in the FIR, the informant had given a loan of Rs. 82,000/- to the petitioner, who had promised to return the same in ten days but the same was not returned. It is stated that subsequently a cheque was given to her son which also bounced. It is further stated that on asking for her money, the accused persons including the petitioner started to beat up

It is submitted by learned counsel for the petitioner that the allegations as levelled in the FIR are false and concocted. It is the family of the informant, who had threatened the petitioner and demanded Rangdari and under coercion, petitioner signed the cheque. She was also assaulted for which she underwent treatment at hospital and has also lodged an FIR (Annexure-2) being Bettiah Town P.S. Case No. 482 of 2019. It is further submitted that the instant case is a counter blast to the FIR at Annexure-2. There is land dispute between the parties and the petitioner who is a lady is in custody since 31.12.2019. The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the submissions made on behalf of the petitioner together with the fact that petitioner being a lady is in custody since 31.12.2019, the court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Bettiah Town P.S. Case No. 589 of 2019 on furnishing bail bond of Rs. 10,000/- with two sureties of the like
