The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 448, 354, 427 and 379/34 of the Indian Penal Code.
Prosecution case is that on 02.08.2015 at 5:30 PM, the petitioner entered into the house of the informant with country made pistol and caught her hand when the informant raised alarm then other accused persons also entered into the house and took away gold chain and cash of Rs.9500/-. It is submitted by learned counsel for the petitioner that the petitioner is next door neighbor and for a petty dispute the accusation has been levelled. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal
Patna High Court Cr.Misc. No.20340 of 2016 (2) dt.11-05-2016 2/2 antecedent. Furthermore, there is no eye witness to the occurrence.
The aforesaid facts constitute ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Sabour P.S. Case No.150/2015, pending before the learned ACJM, Bhagalpur. With the above observation, this application is, accordingly, disposed off.
