Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 120B of the Indian Penal Code and Section 27 of the Arms Act.

Submission is that petitioner is carrying no specific allegation rather, allegation of firing is against co-accused Dinesh Mahto. In past petitioner was allowed anticipatory bail by a Co-Ordinate Bench of this Court in Criminal Misc. No. 24783 of 2018 vide Annexure 3. However, the said order was cancelled in Criminal Misc. No. 58494 of 2018 vide Annexure 4 for the reason that the criminal antecedents of the petitioner was not disclosed in the petition. Petitioner is in custody since 15.02.2019. Learned counsel for the informant opposed the prayer for bail.

No.16467 of 2019(3) dt.19-04-2019 2/2 Considering the entire facts aforesaid, let the petitioner, above named, be released on bail after framing of the charges or completion of two months of custody from today, whichever is earlier, on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Dulhin Bazar Police Station Case No. 306 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
