JUSTICE ANIL KUMAR SINHA ORAL ORDER 29-05-2023 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor representing the State. This application, for grant of anticipatory bail, arises out of Rajepur Police Station Case No. 116 of 2022, dated 18.06.2022, disclosing offences punishable under Sections 147/ 148/149/188/341/342/353/504/506 of the Indian Penal Code. The prosecution case, as per the First Information Report, is that the petitioner, along with other six named accused persons and 25-30 unknown persons, assembled and were protesting against the 'Agniveer' scheme and for which 'Bihar Bandh' was called on 18.06.2022, on which date, the accused persons created a jam on the road and were raising slogans and also caused nuisance and when the police personnel

Patna High Court CR. MISC. No.16574 of 2023(2) dt.29-05-2023 2/3 arrived there and tried to pacify the matter, accused persons became angry and started misbehaving with the police personnel and caused hindrance to the police personnel in the performance of their official duty.

Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in this case and he has not committed any offence in the manner alleged. She further submits that a protest was being made against the 'Agniveer' scheme, in which altogether 40-50 persons had assembled on the road and blocked the same. The allegation against the petitioner is general and omnibus in nature and he is having no criminal antecedent and is aged about 20 years. Regards being had to the submissions advanced on behalf of petitioner and taking into consideration the fact that the petitioner is 20 years old, no injury has been caused to the police personnel and the allegation against the petitioner is general and omnibus in nature, I am inclined to grant the petitioner privilege of anticipatory bail.

This application is, accordingly, allowed.

Let the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, be released on bail on

Patna High Court CR. MISC. No.16574 of 2023(2) dt.29-05-2023 3/3 furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champrana, at Motihari, in connection with Rajepur Police Station Case No. 116 of 2022, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
