2. The petitioner seeks bail in connection with Chakai P.S. Case No. 125/2023 registered for the offence punishable under Sections 328/302/34 of the Indian Penal Code. The petitioner is in jail since 10.04.2023.

3. The petitioner is the father of the victim boy and the mother has alleged that the victim was killed by the father and stepmother. From the postmortem report, it appears that no external injury has been found, but viscera has been preserved for report.

4. In these circumstances, this application is allowed.

5. Considering the period of custody, let the

No.17835 of 2024(2) dt.14-03-2024 2/2 petitioner above named be released on provisional bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, IV, Jamui in connection with Chakai P.S. Case No. 125/2023.

6. It is made clear that if the viscera report comes that the deceased died of poisoning then the bail granted to the petitioner shall be cancelled by the court below. In case, the viscera report comes that the deceased was not poisoned then the petitioner will remain on bail.
