JUSTICE AKHILESH CHANDRA ORAL ORDER 14-01-2015 Heard learned counsel for the petitioner, learned counsel for the informant and learned Additional Public Prosecutor for the State. The petitioner, who apprehends his arrest in connection with a case registered for the offences punishable under Section 498 A of the Indian Penal Code and 4 of the Dowry Prohibition Act, is one of the named accused in this complaint case being husband of the complainant with allegation of certain demands, torture etc.

It is stated that petitioner was kidnapped and marriage said to have taken place in 2011-12, which is not acceptable but since no steps was ever taken against alleged kidnapping and marriage etc., in absence of any such material, the submission cannot be accepted nor in view of the above he appears entitled for the privilege sought. Hence, his prayer for anticipatory bail, in connection with Complaint Case No.1504 C of 2012, pending before the Chief Judicial Magistrate, Khagaria is hereby refused with a direction to the petitioner to surrender before the Court below within a fortnight and seek regular bail, which shall be considered and disposed of on its own merit, in accordance with prevailing law.
