The petitioner apprehends his arrest in Gamharia P.S. Case No. 135 of 2014, registered for the offences punishable under Section 498(A) and other Sections of the Indian Penal Code. The petitioner is husband.
It is submitted that the petitioner never demanded any dowry nor ever assaulted his wife. The informant herself alleged that the petitioner was assaulting his son, but when the informant protested the petitioner assaulted her and drover her out from the house. The marriage was solemnized 28 years ago. Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of
Patna High Court Cr.Misc. No.20429 of 2015 (2) dt.19-05-2015 2/2 receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Sunil Kumar Singh, the learned Judicial Magistrate 1st Class, Madhepura in Gamharia P.S. Case No. 135 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
