The petitioner seeks bail in Mairwa P.S. Case No. 67 of 2016, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code.

Prayer for bail of the petitioner was earlier rejected vide order dated 28.02.2017 passed in Cr. Misc. No. 54916 of 2016 with an observation that the petitioner may renew his prayer for bail after remaining nine months in custody. The petitioner is in custody since 08.11.2016. The petitioner has already remained in jail for more than nine months and the allegation against the petitioner is that the petitioner assaulted Girija Devi with axe on her head and one injury was found on the head of Girija Devi which is opined to be grievous in nature on account of fracture of bone.

Patna High Court Cr.Misc. No.40481 of 2017 (3) dt.06-09-2017 Considering the facts aforesaid and the fact that the petitioner has already remained in jail for about ten months, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate VII, Siwan in Mairwa P.S. Case No. 67 of 2016.
