1. Heard learned counsel for the petitioner and the learned APP for the State.
2. Petitioner seeks regular bail in connection with Beur P.S. Case No. 616 of 2022 dated 27.11.2022 registered for the offence(s) punishable under Section(s) 30(a)/37 of the Bihar Prohibition and Excise Act.
3. The main submissions advanced by the learned counsel for the petitioner are that the instant matter relates to the recovery of 92 litres of illicit country made Mahua liquor and the same is stated to have been recovered from a street (gali) near a community hall and petitioner is stated to have been arrested in front of the said community hall and some other co-accused persons are also stated to have been arrested with this petitioner but the alleged liquor was not recovered from the
Patna High Court CR. MISC. No.20643 of 2023(3) dt.24-05-2023 2/2 conscious possession of this petitioner and he has fair and clean antecedent and has been languishing in jail since 28.11.2022 and against him, the investigation has been completed.
4. Learned APP appearing for the State opposes the bail prayer.
5. Considering the above submissions and mainly the petitioner's fair and clean antecedent and completion of investigation against him as well as his custody period, in my opinion, it is a fit case for bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail in connection with Beur P.S. Case No. 616 of 2022 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned. (Shailendra Singh, J) Sanjay/- U T
