2. The petitioner is apprehending his arrest in Phenhara P.S. Case No. 21 of 2024 registered under Sections 341, 323, 363, 365, 379, 504/34 of the Indian Penal Code and 8 of the POCSO Act.

3. Allegedly, five accused persons riding on three motorcycles having armed with deadly weapons, arrived at informant's house and kidnapped informant's minor daughter for the purpose of marriage. A loot of Rs. 40,000/- and jewelleries wroth Rs. 1,00,000/- was also made in the occurrence. It is also alleged that on resist made by informant's

4. It has been submitted on behalf of the petitioner that the victim returned from Haryana. Her statement under Section 164 of the Cr.P.C. was recorded in which, she has stated that she has solemnized marriage with the petitioner with her own sweet will. According to her deposition, she was 18 years old.

5. Learned APP has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of four weeks, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, POCSO Actcum-A.D.J.-VII, East Champaran, Motihari in connection with Phenhara P.S. Case No. 21 of 2024, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure /482(2) of BNSS, 2023 .
