The petitioner seeks bail in connection with Dulhin Bazar P.S. Case No. 06 of 2017 dated 20.01.2017 instituted for the offences under Sections 399/402 of the Indian Penal Code and Sections 25(1-b)A, 26/35 of the Arms Act.

The petitioner was arrested with one country made pistol and a live cartridge.

Learned counsel for the petitioner has submitted that because of the petitioner not enjoying a clean antecedent, he has been made accused in many cases of this kind by the local police. It has further been submitted that in all the cases in which the petitioner was earlier made accused, for the paucity of evidence against him, he was granted bail in such cases.

Patna High Court Cr.Misc. No.48184 of 2017 (4) dt.02-01-2018 The petitioner is in custody since 20.01.2017 and similarly situated co-accused viz. Niranjan Kumar has been granted bail by a Bench of this Court on 05.07.2017 passed in Cr. Misc. No. 26031 of 2017.

Regard being had to the period of custody of the petitioner in the present case, the petitioner above named is directed to be released on bail on his furnishing bail bond in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge II, Danapur in connection with Sessions Trial No. 496 of 2017, arising out of Dulhin Bazar P.S.
