The petitioner has preferred this application for grant of regular bail in a case registered under sections 302, 201 and 34 of the Indian Penal Code.
As per the prosecution case, the daughter of the informant was married to one Sukhi Chaudhary. It is stated that soon after the marriage the nine named accused persons including the petitioner herein used to beat up and torture the daughter of the informant and ultimately she was burnt to death. It is submitted by learned counsel for the petitioner that the petitioner is innocent and has been falsely implicated in the case. The petitioner happens to be the nephew of the husband of the deceased. The deceased was married to the
Patna High Court CR. MISC. No.26154 of 2021(4) dt.24-12-2021 2/2 petitioner's uncle about 10 year back and have two children. The allegations are general and omnibus in nature. No material has transpired in course of investigation to connect the petitioner with the alleged crime. The husband of the deceased is in custody. The petitioner is in custody since 12.1.2021 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the relationship of the petitioner with the deceased, the petitioner having remained in custody for 11 months and the material that has transpired in course of investigation, the Court directs the petitioner to be enlarged on bail in connection with Akbarpur. P.S. Case no. 133 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada.
