JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-11-2017 The petitioner seeks regular bail in connection with Rasulpur P.S. Case No. 01 of 2016, registered for offences punishable under Sections 364/120(B) of Indian Penal Code and later on added Section 302 of the Indian Penal Code. Allegation against the petitioner is of killing the husband of the informant.

It has been submitted on behalf of the petitioner that he has not been named in the F.I.R, his name has surfaced on confession of co-accused and the said co-accused has already been enlarged on bail and except confession, there is nothing against the petitioner. Further he has been in custody since 09.02.2016. Learned counsel for the State opposed the prayer for bail. Having heard both sides, considering the fact and

Patna High Court Cr.Misc. No.39070 of 2017 (3) dt.21-11-2017 circumstances of the case, serious nature of allegation and also the fact that petitioner is accused in 29 other cases, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, dismiss.

However, the trial court is directed to expedite the trial and try to conclude it as soon as possible.
